RE: The tariff classification of ribbons and narrow fabric from Taiwan

Dear Ms. Pitts:

In your letter dated March 21, 2000, you requested a classification ruling.

You submitted samples of three items. Style M27TG500TF is described as a 30 foot roll measuring 2.5 inches in width of woven gold lame vertical stripe textured ribbon. It has wired edges and the fiber content is claimed to be 65 percent metallic and 35 percent nylon. The gold metallic yarn forms loops on the surface of the fabric. Style M27TG526TF is described as a 30 foot length of knit fabric measuring 2.5 inches in width. Upon examination, it appears that the metallic yarn forms loops on the surface of the fabric. It also has wired edges. You state the fiber content to be 55 percent metallic and 45 percent polyester fiber. Style M27TG550TF is described as a 30 foot length of knit fabric measuring 2.5 inches in width. The metallic yarn appears to form loops on the surface of the knit fabric. The fiber content is stated to be 65 percent metallic and 35 percent nylon.

Subheading note 2B(b) to Section XI notes of the Harmonized Tariff Schedule of the United States states that: “In the case of textile products consisting of a ground fabric and a pile or looped surface no account shall be taken of the ground fabric.” In the case of the three styles above, the loops are formed by metallized yarns. Therefore, for purposes of this ruling they shall all be considered to be of 100 percent metallized yarns. The applicable subheading for style M27TG500TF will be 5806.10.3090, HTS, which provides for narrow woven fabrics, woven pile fabrics, other, other. The duty rate will be 5.3 percent ad valorem.

The applicable subheading for styles M27TG526TF and M27TG550TF will be 6001.29.0000, HTS, which provides for pile fabrics, knitted or crocheted, looped pile fabrics, of other textile materials. The duty rate will be 7.4 percent ad valorem.

Style M27TG500TF falls within textile category 899. Based upon international textile trade agreements products of Taiwan require a visa.

Styles M27TG526TF and M27TG550TF fall within textile category designation 414. Based upon international textile trade agreements products of Taiwan are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
